Well, it seems that perseverance is the strength to my litigation strategy. After four years of a corporate law firm battling for me trying to obtain COVID hospital mortality data, and being rebuffed by the courts, by second efforts have yielded fruit.

Recall, back in January of 2021, 4.5 years ago, I partnered with a corporate lawyer in an effort to expose the euthanasia that Governor Cuomo ordered to happen inside of the 11 state-controlled hospitals, (e.g., Elmhurst, Jacoby, Bellevue, etc.). In early 2020, as the COVID outbreak started, nurse whistleblowers were reporting that the hospitals were placing infected patients on mechanical ventilators when they did not need it, and then were not managing those ventilators, essentially murdering them. This went on from January through April of 2020. The bad press caused the genocide to stop for the most part.

My records requests for ventilator mortality data were denied by the New York State Department of Health (I was able to get the same data from a different source, but that’s for a different story). We proceeded in New York State Supreme Court, and ended up in the highest court. We were denied the data. The crooked courts clearly were covering it up.

However, I never give up. I thought of a strategy after that Phase 1 of the court option ran its course. We submitted new records requests. This time, we worded them to be ironclad based on what we had learned through the litigation.

That was six-months ago. The State of New York was doing the same strategies they did on the first round of requests and were stalling.

Last night, I checked my email and was shocked to see that the state gave me all of the data requested.

One can only guess as to why they are capitulating now. Perhaps it is politically motivated given that Governor Cuomo is close to becoming The Mayor of New York (when he should be in jail instead). I suspect that the far-left Cabal running Albany would prefer to see their own radical candidate win, but who knows (I also recently got the DOJ involved).

Regardless, this is a legal victory. Although we lost the first round in court, my second effort using New York records laws worked.

I have been litigating for 12-years. Perseverance is more important than anything else. Being smart at the law rarely matters because the whole process is so corrupted. You have to be relentless.

(I will now update the medical paper and resubmit it to a major journal. This time, the current Director of the NIH will be a co-author).

Congratulations. Indeed, your perseverance is a rare virtue nowadays. You grew up in a generation where the ability to delay gratification was one of the keys to longterm success in life. Can’t wait to see the paper published.
